Your Police Report After A Summerlin Car Accident

Who Takes The Report When You Crash In Summerlin?

The Las Vegas Metropolitan Police Department, on either side of the city line. The North and West districts are inside the City of Las Vegas and Summerlin South is unincorporated Clark County, but Metro polices both, so the officer who writes up a crash on those streets works for Metro. Hold on to the event number from that paperwork, because you’ll need it to request the report.

How Do You Get A Copy Of An LVMPD Crash Report?

Metro releases traffic collision reports online, by mail or in person, and the fee is $13. A report can take up to 10 business days to become available after it’s filed. If you were a driver in the crash, you can pick up your own copy at the Summerlin Area Command on Redpoint Drive, paying by card, not cash. Once you hire us, we request it for you.

What A Summerlin Personal Injury Claim Can Recover

      Medical Bills, Now And Later

In a personal injury claim, we add up every bill tied to the injury: the ambulance, the emergency room, imaging, surgery, physical therapy and prescriptions. Then we ask your doctors what care you’ll still need, because a demand that counts only past bills leaves the future ones with you. Bills and lost pay are what lawyers call economic damages.

      Lost Wages While You Healed

If the injury kept you off work, we document the shifts and the pay you missed with pay stubs and a letter from your employer. If you work for yourself, your invoices and tax returns do the same job.

      Pain And Suffering

Some losses come without a receipt: the pain, the nights you can’t sleep, the weekend rides or hikes you’ve put off since the crash. Lawyers call these non-economic damages, and most people call them pain and suffering. We document them through your medical records and through the people who see you every day.

What A Personal Injury Lawyer Costs

You don’t pay us anything up front, and there’s no fee unless we recover money for you. Ours is a contingency fee: a percentage of what we recover, set in a written agreement you sign when you hire us. We cover the case costs as the case moves, and they’re repaid out of the recovery at the end. No fee unless we recover refers to attorney fees. Case costs and expenses may apply and can differ from fees. Ask us to explain both.

Personal Injury Cases We Handle In Summerlin

Katie takes each kind of personal injury case below for people hurt anywhere in the valley, from a traumatic brain injury (TBI) or another catastrophic injury after a freeway crash to a broken wrist from a fall in a store. Whether you searched for a car accident lawyer in Summerlin or for help after a motorcycle or bicycle accident, a dog bite, a slip and fall or a wrongful death, these are the cases she handles. Hurt at work? A work injury usually starts as a workers’ compensation claim, which runs on its own deadlines; the questions near the end of this page cover them.

Summerlin Accidents, From The 215 To Red Rock Canyon

Car And Motorcycle Crashes On Summerlin Parkway And The 215

The parkway is a state highway, Nevada State Route 613, running from the 215 Beltway east to Tenaya Way. When a wreck on either road involves several cars, a motorcycle or a rideshare driver, the first job is working out which driver caused which impact, since every insurer involved would rather the blame land on another driver. We start with the police report, the scene photos and the damage to each vehicle, and we ask other drivers and nearby businesses for video early.

Bicycle Accidents On Charleston Boulevard And Red Rock’s Scenic Drive

Charleston Boulevard runs west out of Summerlin as State Route 159 to Red Rock Canyon National Conservation Area, where the 13-mile Scenic Drive is shared by cars, bicycles and people on foot. On the way out, Nevada law requires drivers to give at least 3 feet when passing a bicycle, e-bike or e-scooter, and they face an enhanced penalty if they cause a crash. That rule supports a negligence claim for a rider who was clipped, and ride data from a bike computer or phone can show where you were on the road.

Slip And Fall Injuries At Downtown Summerlin Stores And Garages

The district sits just east of the 215, between Sahara Avenue and Charleston Boulevard, with shops, restaurants and offices. A fall there is a premises liability claim rather than a road crash, and the proof is usually the business’s own camera footage and incident report. We ask for both in writing right away, because stores don’t keep video forever.

How A Personal Injury Case Works, From The First Call To Court

      Medical Treatment Comes First

Your recovery sets the pace. We don’t send a demand until your doctors can say how far you’ll heal, the point called maximum medical improvement, and what care you’ll still need, because a settlement signed too early can leave a later surgery unpaid. That’s most of the answer to how long a Nevada car accident settlement takes: it waits on your treatment.

The Demand Letter And The Insurer’s Offer

When the medical picture is clear, we send the insurer a demand with the police report, your records and bills, proof of lost pay and a written account of what the injury has cost you. The insurer answers with an offer, and we negotiate from there.

A Lawsuit In The Eighth Judicial District Court

If the insurer won’t pay what the claim is worth, we file a lawsuit. Most personal injury lawsuits here are filed in the Eighth Judicial District Court, the trial court for all of Clark County, which covers both the city and the county sides of Summerlin. The court’s Regional Justice Center is downtown at 200 Lewis Avenue.

      Evidence, Mediation And Trial

After filing, both sides exchange evidence and take sworn testimony from the drivers, witnesses and doctors, and they can try mediation with a neutral mediator before trial. Katie prepares each case as though it will be tried, and in our experience insurers take a case more seriously once the other side is plainly ready for trial.

Recent Google Reviews Of Goldberg Injury Law

Put her number in your contacts and if you ever get into an accident, text her right there at the scene and she’ll respond! That’s exactly what I did.

I was in an accident towards the end of April and my case got settled just a couple of months in, with both the party at fault and my own insurance paying out the full policy limit.

During the process April and Katie were communicative, clear on expectations and the process, and were kind and understanding while I was having a complete meltdown from being in so much pain, not seeing progress in my health, and not being able to work.

They helped me get compensation that was fair so that I can continue to get the treatments I need, in a quick turnaround too. I’m so thankful for my case manager April and for Katie!

      Natalie Gamez ★★★★★

Katie and her team were so helpful through everything. Always available to answer any question I had. They made me feel comfortable every step of the way. Katie will even take a late call, which was beneficial with my schedule. I couldn’t be happier with all of the help during the process and the end result was amazing!

      Angelica Valdez ★★★★★

What The Insurer Will Argue About Your Injury Claim

What If You Were Partly At Fault?

Nevada uses modified comparative negligence (NRS 41.141). You can still recover as long as you’re not found more than 50% at fault, and your share reduces the award: at 30% at fault on a $100,000 case, you recover $70,000. Expect the insurer to argue about percentages early. We answer with the report, the scene evidence and the rules the other driver had to follow.

What If The Other Driver Carries Only The Minimum?

In Nevada, the minimum required auto liability coverage is 25/50/20: $25,000 for bodily injury or death of one person, $50,000 per accident when two or more people are hurt, and $20,000 for property damage. When your bills run past that, underinsured motorist coverage on your own policy, if you have it, pays the damages above their limit, up to your own. Nevada requires insurers to offer it, so we read your policy early.

Can A Hospital Take Part Of Your Settlement?

Yes. In Nevada, a hospital can place a lien on your injury settlement or judgment, but it has to record the lien and serve it before payment for the lien to be valid. The lien can’t reach your attorney’s fees, and when you may qualify for Medicaid, Medicare or CHIP, the hospital can recover no more than 55% of its billed charges through it. We check each lien against those rules before any money goes out.

Nevada’s Statute Of Limitations For Personal Injury Claims

Two Years For An Injury Or Wrongful Death Claim

In Nevada, you generally have 2 years from the date of injury to file a personal injury lawsuit. Miss that deadline and you can lose the right to recover, so it’s important to act early. A wrongful death case generally must be filed within 2 years of the date of death, which can come later than the crash. Claims against a government body and medical malpractice claims run on their own deadlines.

Three Years For Damage To Your Car

The deadline to sue for damage to personal property such as your vehicle is 3 years, which is longer than the 2-year deadline for injuries from the same crash. One collision can create two separate deadlines, and we track both from the day you hire us.

Frequently Asked Questions About Your Personal Injury Claim

Do You Need A Summerlin Car Accident Lawyer?

Not always. If the crash was minor, nobody was hurt and the other driver’s insurer is paying for your car, you may not need a Summerlin car accident attorney at all. Call us when you’re injured, when fault is disputed or when the other driver’s coverage looks too small for your bills. The evaluation is free, and Katie will tell you if it’s a claim you can handle yourself.

What If A Neighbor’s Dog Bit You?

Nevada has no automatic-liability dog-bite law, so these cases run on the owner’s negligence and knowledge that the dog was dangerous, plus local dangerous-dog rules. The owner’s homeowner’s or renter’s insurance usually covers the claim. Get the bite treated and photographed, write down the owner’s name and address, then follow the steps for what to do after a dog bite in Las Vegas.

What If You Were Hurt At Work In Summerlin?

A work injury usually starts as a workers’ compensation claim. Nevada workers’ compensation is a no-fault system under the Nevada Industrial Insurance Act. It covers medical care, temporary and permanent disability, vocational rehabilitation, and death benefits. Tell your employer in writing as soon as you can, and within 7 days, using the C-1 form, and file the C-4 form with the insurer within 90 days of the injury or treatment. Our work injury page covers the rest.

Can Your Family Bring A Wrongful Death Claim?

Yes. A Nevada wrongful death case generally must be filed within 2 years of the date of death. The law lets the heirs of the person who died, the estate’s personal representative, or both, bring the claim. We start with a free conversation with the family about what happened, and our wrongful death page explains more.

Should You Talk To The Other Driver’s Insurance Company?

Tell your own insurer about the crash, but talk to us before you give the other driver’s insurer a recorded statement. Their adjuster often calls early, before anyone knows how badly you’re hurt, and what you say on that call stays in the claim file. Once you hire us, we take those calls for you.

What Should You Bring To A Free Case Evaluation?

Whatever you have is enough to start. The most useful items are the police event number or report, photos of the scene and your injuries, both drivers’ insurance details, your medical records and bills, and pay stubs or invoices for the work you missed. Letters or emails from an insurer help too. If you don’t have them yet, we can request most of them for you.

This information is general and not legal advice. Every case is different. Talk to a licensed Nevada attorney about your situation. Contacting this firm or reading this page does not create an attorney-client relationship. Insurance coverage and claim outcomes depend on your policy and your insurer’s decision. We do not control your claim result. Past results do not guarantee a similar outcome. Each case depends on its own facts.
